1. General Provisions
One of the fundamental principles in the work of JLLC «Belarusian Cloud Technologies» (hereinafter referred to as the «Company») is to ensure the protection of the confidentiality of its customers and partners in the business community. This document describes the procedure for ensuring confidentiality (hereinafter referred to as the «Policy»), including the rules for the collection, use, disclosure, transfer and storage of data about the visitors to the website becloud.by (hereinafter referred to as the «Site») and users of the services provided on the Site.
2. Terms and Definitions
User of the Site. (hereinafter referred to as the User) – directly or indirectly specified individual (subject of personal data) who has access to the Site via the Internet and is a user of the Site's services.
Personal Information. Any information related to the User, including, but not limited to: last name, first name, patronymic, gender, mobile phone number and / or e-mail address, marital status, date of birth, hometown, family ties, home address, education information, the information about the type of activity. Data that is automatically transmitted in the process of using the services of the Site using the software installed on the User's device, including the IP address, information from cookies, information about the user's browser (or other program through which the services of the Site are accessed), access time, address of the requested page.
Other information about the User, collection and / or provision of which is defined in the Offer Agreement and amendments to it.
Processing of personal data – any action (operation) or a set of actions (operations) performed with the help of automation tools or without using such tools with personal data, including collection, recording, systematization, accumulation, storage, clarification (update, change), extraction, use, transfer (distribution, provision, access), depersonalization, blocking, deletion, destruction of personal data.
Site Administration – employees of the Company responsible for managing the site, organizing and (or) collecting and processing personal data, as well as determining the purposes of personal data processing, the composition of personal data to be processed and the procedure for actions (operations) performed with personal data.
Cookies are a small piece of data that the Site with the permission of the User sends through a web browser to the hard drive of the User's computer, which makes it possible for the Site to recognize the User's browser, collect and remember information about the User, remember and process information about the User's visits to the Site, recognize the User's settings for future visits, collect general data about traffic and interactions with the Site. The user can accept or reject cookies. Most web browsers automatically accept Cookies, however, the User can independently change their settings and completely prevent the browser from accepting all the Cookies.
Confidentiality of personal data is a mandatory requirement for the Company or other person who has access to personal data to prevent their dissemination without the consent of the subject of personal data or without any other legal grounds.
IP-address is a unique network address of a node in a computer network built using the IP protocol.
3. Use of the Site
The Site cannot be used in a way that could damage the Company's servers or network, overload or disable them, or prevent others from using the Site.
When using the Site it is prohibited to use information retrieval tools, robots or similar means of collecting and extracting data from the Site's content, as well as to reproduce, reprint, copy, save, openly display, broadcast, transmit, modify, translate, transfer, publish, sublicense, assign , send, sell, lend or otherwise distribute the content of the Site.
Using the Site means acceptance of this Policy and the terms of processing the User's personal data.
In case of disagreement with the terms of the Policy the User must stop using the Site.
4. Purpose of collecting personal data
The provision of personal data is necessary to register users of the Site’s services, to purchase of services, to provide information and technical support and to pay for services provided.
For the security of customers special programs may be used to track the attempts of unauthorized access to the site or personal data of users. These programs may also collect personal information from users for their security.
Personal information (email address, system data and problem description) can be used to provide the real-time technical support (e-mail, online chat, online support system). In these cases a copy of the email may be saved with the customer's email address and a response from the support team. Such correspondence is kept confidential.
Personal data is also used to notify about the state of the current account, about the changes in the conditions for the provision of products and services and about new products, services and special offers (newsletter). In case of registration of a refusal from the newsletter during registration or through the support service, personal data is deleted from the mailing address database. At the same time to saving of such data on backups or in reports is possible.
5. Procedure and options for providing / receiving personal data
When visiting the Site the server may collect information for the purpose of analyzing visits to certain pages. In this case the company can view:
- IP address;
- type of browser or user's computer;
- the number of links viewed on the Site;
- region or country from which the Site was viewed;
- date and time of visiting the Site;
- data of the Internet provider;
- the page from which the transition to the Site was made;
- history of visits to the pages of the Site.
6. Aggregate data
Aggregate Data means data that has been deprived of unique information to potentially identify customers, landing pages or end users, and that has been modified or combined to provide aggregated, anonymous information for internal use and for sharing with others on a selective basis. All personal information is stored in Aggregate Data anonymously.
7. Security and protection of the information
To prevent loss, misuse, alteration or unauthorized disclosure of information technical security measures are used on the Site. Customers’ financial information (e.g. bank account information, credit card number) is protected with the help of SSL technology.
Electronic messages (for example, by e-mail or in the online manager) will not be protected, unless the Company arranges the receipt of data via a secure connection in advance. For this reason the Company asks not to send confidential information over unsecured connections. The company is not responsible for the content of personal data provided by customers.
The Company is not responsible and cannot control the use by other persons of any information that may be transferred to the third parties when using the services of the Site, as well as for the content of personal information or any other information received from other users using the services of the Site. The Company is not responsible for the verification, accuracy of personal information or other information provided by the third parties, or for the use of such information by the Company's clients.
In case of loss of personal data by the client for its recovery the Company will request the provision of identity documents of the requestor, or will carry out the identification procedure in accordance with the regulations established on the website. The company may be obliged to disclose your personal information in accordance with the law, the requirements of legal proceedings, court proceedings or at the request of the government authorities of the country of your residence or other countries, as well as for other important purposes (in connection with the transfer of client’s assets).
8. Obligations of the parties
The user is obliged:
- Provide complete and reliable information about personal data required to use the Site;
- Update the provided information about personal data in case of changes in this information.
The administration is obliged:
- Use the received information exclusively for the purposes specified in this Policy;
- Ensure confidentiality when working with personal data, do not disclose personal data without the prior written permission of the User, and also do not sell, exchange, publish or disclose in other possible ways the transferred personal data of the User, except for the cases that oblige the Company to disclose personal data in accordance with applicable law and the provisions of this Policy;
- Take precautions to protect the confidentiality of the User's personal data in accordance with the procedure used to protect this kind of information;
- Block personal data related to the relevant User from the moment of contact or request of the User, or his legal representative, or authorized body for the protection of the rights of subjects of personal data for the period of verification in case of revealing inaccurate personal data or illegal actions.
The site administration which has not fulfilled its obligations is responsible for losses incurred by the User in connection with the unlawful use of personal data in accordance with the legislation of the Republic of Belarus, except for the cases set out in the provisions of this Policy.
9. Exemption from liability
In case of loss or disclosure of personal information the Site Administration is not responsible if this confidential information:
- became public domain before its loss or disclosure;
- was received from a third party prior to its receipt by the Site Administration;
- was disclosed with the consent of the User;
- was provided by the Site Administration at the request of the competent authorities in accordance with the requirements of the legislation of the Republic of Belarus.
10. Final provisions
The company reserves the right to modify this document at its sole discretion. All the changes made take effect after they are announced on the company's website.
